NOTICE OF TRUSTEE'S SALE
NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated January 25, 2005, executed by Borrower(s), Sherri L. Rose and Tony L. Rose, to Danny W. Barie, the Trustee of record in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 1033, at Page 545. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 135 Bamboo Way Lot M, Lashmeet, WV 24733. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated February 3, 2026, of record in the Clerk's Office. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Mercer County, in Princeton, West Virginia, on the following date::
26th day of March, 2026
at 12:00 p.m.
All of that certain lot or parcel of land situate on Reece Harmon Ridge near Lashmeet, in Rock District, Mercer County, West Virginia, known and designated as Lot No. "M" as shown on a map made by Dana Pettrey, L.L.S., entitled, "Plat of Survey Showing division of a portion of the Homer & Mildred Eller tract as described in Deed Book 501, at page 562, which is situate on Reece Harmon Ridge at Lashmeet, in Rock District, Mercer County, West Virginia, by Dana Pettrey," which said Lot "M" more fully bounded and described as follows:
"BEGINNING at an iron pin set in the east line of an access roadway which marks the common west corner of Lots "M" and "N"; thence N. 51° 53' 30" E. 98.82 feet with the common line of Lots "M" and "N" to an iron pin set in the southwest line of Lot "L"; thence S. 46° 29' E. 121.78 feet to an iron pin set at the common corner of Lots "K", "L" and "M"; thence S. 26° 36' 20" W. 163.46 feet with the common line of Lots "K" and "M" and the West line of a 16 foot wide right-of-way to an iron pin set; thence S. 30° 12' 30" W. 36.09 feet with the common line of Lots "J" and "M" and continuing with the West line of said 16 foot wide right-of-way to an iron pin set; thence N. 20° 28' W. 213.68 feet with the east line of an access roadway to the BEGINNING, containing 0.503 acre, more or less."
BEING the same property conveyed to Sherri L. Rose and Tony D. Rose, wife and husband by deed dated January 25, 2005, of recorded in Deed Book 878, Page 410, in the Office of the County Court Clerk of Mercer County, West Virginia.
TERMS OF SALE:
1) The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code §11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) Pursuant to the Financial Crimes Enforcement Network's Residential Real Estate Reporting Rule (31 C.F.R. Part 1031), effective March 1, 2026, certain non-judicial foreclosure sales involving purchasers that are legal entities or trusts and that include cash consideration may be subject to federal reporting requirements. Any successful bidder that is a legal entity or trust and paying cash shall be required, as a condition of sale, to retain a licensed West Virginia attorney to conduct the closing, who shall be designated in writing as the Reporting Person responsible for all required FinCEN filings and record retention. Trustee shall not act as the Reporting Person and shall have no responsibility for compliance with FinCEN report-ing requirements.
7) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
