NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated April 27, 2017, executed by Borrower(s), Aaron M. Chapman, to Show Harold B. Wolfe, III, the Trustee of record in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 1334, at Page 662. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 493 Lakeland Drive, Bluefield, WV 24701. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated March 30, 2022, of record in the Clerk's Office in Book 1437, Page 365. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Mercer County, in Princeton, West Virginia, on the following date:

all those certain lots, tracts or parcels of land situate in the Beaver Pond District, Mercer County, West Virginia, being more particularly bounded and described as follows:
All of Lot No. 224 on a Map bearing the legend, "Plat of Survey Showing Lot. 224 of Lakeland Park. Subdivision Which is Located Near Glenwood Lake Approximately 5 Miles West of Princeton. In Beaver Pond District. Mercer County, West Virginia. Dana Pettrey & Associates P.O. BOX 641 Athens, West Virginia Date; 6/1/79, Scale: 1" = 30' Rev. 8/2/79, by D.P. Is/Dana Pettrey", of record in the aforesaid Clerk's Office in Microfilm Plat Record as #7287, (also see Microfilm Plat No. 12366), more particularly bounded and described as follows:
BEGINNING at an iron pin found on the South side of a 40 foot wide street and with said 40 foot wide street, Chord bearing S. 61° 54' 29" E. 83.292 feet to an iron pin found, common corner of Lots 223 and 224; thence with the dividing line between said two lots, S. 36° 26' 53" W. 143.902 feet to an iron pin, a corner of Lots 208, 223 and 224; thence with the dividing line between Lots 208 and 224, N. 51° 45' W. 20.0 feet to an iron pin, corner of Lots 208, 224 and 225; thence with the dividing line between Lots 224 and 225, N. 8° 04' 51" E. 79.490 feet to an iron pin; thence N. 14° 31' 00" E. 66.000 feet to the, point of BEGINNING, and containing 0.182 of an acre, more or less.
And being the same property conveyed unto Justin L. Faris and Katelyn Faris from Bryan David Rotenberry and Kimberly Sue Rotenberry by deed dated the 12th day of August, 2015, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed Book 1023 at Page 95.
This Deed is made subject to a Declaration of Restrictive Covenants, Conditions and Reservations recorded in Deed Book 576, at Page 44.
TERMS OF SALE:
1)The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property.
2)The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3)The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4)The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5)The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6)The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
