TRUSTEE'S SALE OF 221 FINCASTLE LANE, BLUEFIELD, VA 24605. In execution of a certain Deed of Trust dated April 18, 2022, in the original principal amount of $165,656.00 recorded in the Clerk's Office, Circuit Court for Tazewell County, Virginia as Instrument No. 220001175. The undersigned Substitute Trustee will offer for sale at public auction in the front of the Circuit Court building for Tazewell County, 101 Main Street, Courthouse Building, Tazewell, Virginia, or any such temporary alternative Circuit Court location designated by the Judges of the Circuit Court, on October 16, 2025, at 2:30 PM, the property described in said Deed of Trust, located at the above address, and more particularly described as follows: ALL THAT CERTAIN LOT OR PARCEL OF REAL ESTATE WITH THE APPURTENANCES THEREUNTO BELONGING, SITUATE ON THE SOUTH SIDE OF CUMBERLAND AND FINCASTLE TURNPIKE, DESIGNATED AND DESCRIBED BY SURVEY MADE BY W. N. LAMBERT, CITY ENGINEER (1955), AS FOLLOWS, TO-WIT: "BEGINNING AT A PIN IN THE SOUTH LINE OF CUMBERLAND AND FINCASTLE TURNPIKE THIS POINT BEING A COMMON CORNER OF THE J. M. ALLEN TRACT AND THE M. R. LOUTHAN TRACT; THENCE, LEAVING SAID ROAD AND ALONG THE DIVISION LINE BETWEEN THESE TWO TRACTS, S. 17deg. 00' E. 135.45 FEET TO A STAKE; THENCE N. 73deg. 00' E. 146.7 FEET TO A STAKE IN THE WEST LINE OF A 20 FOOT STREET; THENCE N. 17deg. 00' W. 98.0 FEET TO A STAKE IN THE CUMBERLAND AND FINCASTLE ROAD; THENCE ALONG SAID ROAD N. 87deg. 39' W. 40.6 FEET TO A STAKE; THENCE S. 86deg. 06' W. 111.7 FEET TO THE POINT OF BEGINNING." TERMS OF SALE: ALL CASH. A bidder's deposit of ten percent (10%) of the sale price or ten percent (10%) of the original principal balance of the subject Deed of Trust, whichever is lower, in the form of cash or certified funds payable to the Substitute Trustee must be present at the time of the sale. The balance of the purchase price will be due within fifteen (15) days of sale, otherwise Purchaser's deposit may be forfeited to Trustee. Time is of the essence. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled to a return of the deposit paid. The Purchaser may, if provided by the terms of the Trustee's Memorandum of Foreclosure Sale, be entitled to a $50 cancellation fee from the Substitute Trustee, but shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee's attorney.
